قال الشافعى و احب للامام اذا اولى القضاء رجلا ان يجعل له ان يولى القضاء من راى فى الطرف من اطرافه فيجوز حكمه , اما الامام فيجوز له ان يستخلف على القضاء و ان قدر على مباشرته لعموم ولايته كما يجوز ان يستخلف على غير القضاء فيما يقدر .
